The question is not just whether it is legally right because even legally it is highly questionable.

Just because the 3 Appeal Court Judges accepted the Preliminary Objection (PO) does not mean they are right. Simply because, according to the lawyer on the other side, they were not given a chance to explain why it is illegal for a Chief Minister to be dismissed by the TYT within 48 hours of appointing him, when the Constitution states that only the Assembly can unseat a CM by Vote of Confidence.

As the Federal Constitution now stands, the Agong cannot arbitrarily dismiss the PM. Neither can any Menteri Besar be dismissed by the respective Sultans without undergoing the due process as laid out in their respective Constitution.

In the case of Sabah, following the May 9th GE14 and almost 48 hours after the election results were announced, and despite the eventual winner who had 29 seats and commanded a simple majority, with and addition of 2 more seats, had the rug pulled out from under his feet despite having been sworn in.

After unexplained lengthy delay, a swearing-in was promised at 8pm, until 11pm Musa was kept waiting to be sworn in. Almost 24 hours after results were announced, and that within 10 hours the next day he was asked to return the Appointment Letter. This lead many people to believe that horsetrading was going on. Which was confirmed when Upko Assemblymen frogged to Warisan side. At the time of the appointment of the CM this was not the case and he was sworn-in, so why did he have to lose his job after being sworn-in? With the new victors, resorting to Statutory Declaration (SD) rather than people’s vote, which is more important.

Similarly, the Prime Minister was made to wait several hours by the previous Agong after PH victory and that he too complained loudly that this should not have happened as people have spoken. In his case, the previous Agong apparently was abroad.

So, if this was unacceptable to the PM, what happened on the 9th May 2018 be acceptable to Sabahans? Fortunately, in the case of the PM, no Pakatan members frogged-over to BN to deny Dr Mahathir and Pakatan Harapan a victory. Perhaps it was due to the margin of seats being wide unlike in the Sabah case. Nevertheless, an unacceptable delay was allowed to happen with the PM being appointed but in Sabah a CM was also being constitutionally appointed. But yet, losing it due to horsetrading, never-mind the constitution, a Law Expert even joked in a seminar in Kota Kinabalu that Sabah politicians can win a medal for frog politics or something like that.

Its a pity that the Appeal Court Judges accepted the PO to deny the aggrieved in court.

The Counsel for the other side claimed on the grounds that any outcome is academic and he  based it on two main arguments :

1) even if Musa succeeded with his appeal there will be no consequence/outcome because Musa can never satisfy the threshold of Article 6 (3) of the Sabah Constitution which expressly states that the TYT appoints a member of the Assembly to be CM who has the command of the confidence of the majority of the members of the Assembly.

2) even if the Assembly is summoned, with the support of only eight out 60 assemblymen factually and mathematically Musa can never win a vote of confidence for himself or a vote against Shafie and unseat him.

Douglas Lind’s contention the case is academic.

However the larger question is not whether the successor commends the majority in the house the present moment, but whether it was Constitutionally correct to ask back from the CM, the letter of appointment. Just because subsequent to the appointment a bunch of politicians leapfrogged. Hence it is a question of whether it was legally right as well as morally right. From my understanding of the Constitution it was both legally and morally wrong and  I remain to be convinced.

My point is that the PM complained about having to wait long before being sworn-in following the GE14 results. In Sabah, a delay also happened in swearing in the CM but with different consequences.

Imagine if the PM was asked by the Agong to return the appointment letter just because some Pakatan Harapan winners decided to frog over to Barisan Nasional?

Would it then be a case of asking the PM to resign and not sacked?

The larger issue is also, does not what happened in Sabah raise the question, if unchallenged in the Federal Court, that to ordinary people like me, the TYT is the only head of state that can decide whether a CM that he had just constitutionally appointed can be dismissed by him within hours of doing so without going through the State Assembly, which is the rightful place to determine this.

By the same reasoning, does it not seem that the Sabah TYT may be seen to have powers that even the Agong and Sultans do not? I stand to be corrected?

Courts should have looked at whether a Sabah TYT enjoys greater powers than the Agong and Sultans in appointing the head of government and to help rectify if indeed this is the case now.

Because this problem is not addressed and peculiar to Sabah, this tendency of a Sabah TYT to delay appointing a CM has created crises on 3 occasions.

In 1985, 1994 n 2018.

Peoples voices not recognised in this 3 instances of Sabah’s political history – 1985, 1994 and 2018. In all 3 instances, the decisions took a different turn and the government was formed by frogging and other means.

In 1985, Party Bersatu Sabah (PBS) won the Sabah State election with a simple majority of 25 seats. However, PBS was not allowed to form the Sabah State Government by the Istana.

Joseph Pairin Kitingan was kept waiting for more then a day while power grab was underway in the wee hours of the morning. In which, USNO’s 16 seats collaborated with Berjaya’s 6 seats and the Sabah State Government was formed before the sun rose.

The schemers of this plan decided they can still form the government by laying claim to the 6 nominated state seat. The then Prime Minister Dr Mahathir was in Scandinavia and his deputy Musa Hitam had ordered the plotters to give up. Joseph Pairin Kitingan was then only sworn in as Chief Minister after almost 48 hours.

In 1994, something similar happened again with Pairin Kitingan and PBS as victims. This time, Pairin also won with a simple majority of 25 seats despite massive frogging by his assemblymen to government side due to the scrapping of the Anti-Hopping Law (The Barisan Nasional government challenged the Anti-Hop Law that was introduced in 1987 by the then PBS State Government in court and had it scrapped).

This time Pairin had to camp for 3 nights outside the Istana as the then TYT claimed he was too sick to open the Istana gates for Pairin to be sworn in. By the time the Istana gates were opened Pairin had already lost many of his Assemblymen and a new Chief Minister was sworn in after about a month. This eventually led to the downfall of the PBS State Government as the PBS election winners had joined Barisan Nasional parties.

In 2018, it happened again following GE14. But this time there was a major difference. While in 1985 and 1994 Pairin was not able to be sworn in instantly after the election results, this time, Musa Aman was already appointed Chief Minister after an unexplained delay of about 48 hours. And despite being sworn in with his Cabinet members, Musa Aman still lost his government to frogging.

This time the Upko boys did the frogging probably on the orders and advise of Tan Sri Bernard Dompok and despite pledging that as KDMs they will stick together and decide as a bloc and only leave the BN after consensus among themselves. Five assemblymen from Upko and one MP left BN to throw their support behind Warisan and Pakatan Harapan, a day after the general election.

Their action caused the collapse of the BN government led by former chief minister Musa Aman whose cabinet, which included two Upko assemblymen, had been sworn in less than 12 hours before.

I was there on that night of May 9th in Sri Gaya when Tangau came out and answered a phone call apparently from Dompok asking him to go to Shafie’s house in Luyang. Tangau disappeared from Sri Gaya after this phone call and headed straight to see Shafie in his house, alone, leaving all his UPKO boys with Musa Aman in Sri Gaya. Upko then switched allegiance to the Warisan-Pakatan Harapan pact a day after the election.

For how long more must Sabah continue to be the only state where the Assemblymen decides who is to form the government by becoming political frogs and not by the people who voted them?

In the end the CM is appointed through political frogs producing statutory declarations  (SD) instead of the peoples wish being respected.

Lets hope a right decision is made by the Court of Appeal on this November 28th on the appeal of Musa Aman against the High Court ruling over the legitimacy of Shafie Apdal as the Sabah chief minister.

Comparison has been made between Sabah CM row and the Perak Mentri Besar tussle. However it must be stressed that they are entirely different.

In the Perak case, the Sultan acted before the new Mentri Besar was appointed.

In the Sabah case, the worst case scenario happened, despite the CM and the Cabinet already sworn in.

In the Perak case, everyone is the Sultan’s subject and the Sultan has the right.

But in the Sabah case, it does not have a Sultan but only a Governor, who himself is nominated by politicians of the day.


PKR president Anwar Ibrahim our PM-in-waiting is coming to Sabah on the 17th of September 2019. I’m made to understand that on reaching Kota Kinabalu, Anwar is expected to go to Kota Belud immediately where thousands of USBO (United Sabah Bumis Organisation) members including Pandikar Amin Mulia, Salleh Said Keruak, Amir Kahar Tun Mustapha among others will be officially joining Anwar’s PKR.

It seems USBO wants to rev up Muslim support for Anwar in Sabah.

Interestingly, Shafie Apdal from day one has been trying to win over USBO into Warisan, but seems like he has failed.

USBO’s membership is made up of Bajau, Bajo, Badjau, Jama Mapun or Kagayan, Balangingi, Binadan, Kubang, Sama, Sama Delaut, Simunul, Sibutu, Sikubung, Yakan, Sibaud, Ubian, Suluk and Iranun individuals.

USBO was formerly known as Persatuan Sabah Bajau Bersatu (PSBB) formed on June 15, 1964 and changed its name to USBO on Aug 31, 2006.

Sabah politics is getting more and more interesting. With this USBO move, PKR will be even stronger than Dr Mahathir’s Bersatu, and would certainly take the wind out of Warisan’s sails. USBO for sure is going to create a stir among political circles in Sabah with this move.

Lets wait and see.

GEORGE TOWN: The visit by PKR president Datuk Seri Anwar Ibrahim to Kota Belud, Sabah, on September 17 is on the invitation of the Bajau community in the state, said PKR secretary-general Datuk Seri Saifuddin Nasution Ismail. He dismissed speculation that Anwar’s visit to Sabah with several of the party leaders was to recruit or receive new PKR members. “We were invited on September 17 to Kota Belud by the Bajau community. We know Sabah has so many different ethnic (groups). They invited Datuk Seri Anwar and the rest of the party leaders,” he said, adding that as party president, Anwar was often invited by people from all walks of life. “This time, he accepted the invitation by Sabah, it is not an event to receive (new) members,” he told reporters after launching a blood-donation and health programme in Pantai Jerejak..

A news portal reported speculations that former Cabinet Minister Datuk Seri Salleh Said Keruak and former Dewan Rakyat Speaker Tan Sri Pandikar Amin Mulia would be joining PKR. According to the report, United Sabah National Organisation (Usno) information chief Musli Oli was quoted as saying both were among several leaders of the Bajau community in Sabah who will be making the move. It is understood that Salleh and Pandikar Amin will be submitting their applications to join PKR after the Malaysia Day celebrations on September 16.

In December last year, Salleh and Pandikar Amin announced they were quitting Umno to become independent politicians. They are among nine Sabah Umno state assemblymen, four Members of Parliament, two senators and 21 division leaders who left the party.


Shafie Apdal’s dislike for Dr Mahathir’s Bersatu is so clear.

In April this year, the Sabah chapter of Dr Mahathir’s Bersatu was launched with nine assemblymen — eight from Umno and one from Parti Bersatu Rakyat Sabah — and five MPs. Now Dr Mahathir’s Bersatu is the second largest party in the Sabah state government and can boast to have close to 300,000 Sabahan card-carrying members, and more new members are joining, some even Warisan supporters from Sembulan and Likas.

Right from the beginning after taking over power as Chief Minister from Musa Aman, Shafie didn’t want the entry of Dr Mahathir’s PPBM (Bersatu) into Sabah.  After 15 months the differences deepen. There’s nothing new about a Warisan-Bersatu row. But when Bersatu happens to be Dr Mahathir the Prime Minister, and the chief minister, Shafie, the row is more like a clash of titans.

This video below showing Shafie criticising Dr Mahathir’s Bersatu (PPBM) and likening it to Umno has gone viral in Sabah. In the clip, Shafie is seen in casual conversation with at least two ladies about Dr Mahathir’s Bersatu and is heard saying that the party is “just like Umno”, and asked why they would join Dr Mahathir’s Bersatu? While the woman said that they heard they will lose their voice in Warisan.

KOTA KINABALU: Chief Minister Shafie Apdal today dismissed a video of him appearing to equate PPBM with Umno, saying the clip which has been making the rounds on social media is an old one.

Speaking to reporters after an event here today, Shafie, who is the president of Warisan, said the remarks in the video were about PPBM spreading its wings to Sabah.

“Previously, we had an understanding that PPBM would not enter Sabah,” he said.

“We knew there were members in our party who doubted and who were concerned, as well as those who wanted to leave because they had no positions.

“But it’s an old story. Today we are together, so we will work with each other with PPBM in the state.”

In an agreement with Warisan before the general election last year, PPBM said it would not set foot in Sabah.

However, the party chaired by Prime Minister Dr Mahathir Mohamad launched a chapter in the state in April.

The two-minute clip in question had shown a man resembling Shafie holding a lively conversation with several women who are believed to have sought his views on joining PPBM.

“This PPBM is Umno. Why do you want to join them?” he asked.

He also said that joining PPBM would be akin to supporting Sabah PPBM chief Hajiji Mohd Noor, the former Sabah Umno chief who led dozens of Sabah Umno members to cross over to PPBM early this year.

Dakwaan Tidak Hadir Sambutan Hari Kebangsaan Peringkat Negeri

KOTA KINABALU:Respond Menteri Pembangunan Infrastruktir Sabah, Datuk Peter Anthony, berhubung ketiadaan Ahli-Ahli Dewan Undangan Negeri (ADUN) Parti Pribumi Bersatu Malaysia (Bersatu) Sabah dalam Majlis Sambutan Hari Kebangsaan Peringkat Negeri Sabah semalam, menimbulkan persoalan.

Peter yang juga merupakan Pengerusi Penganjur menyatakan bahawa urusetia telah menghantar surat jemputan kepada para ADUN Bersatu Sabah.

Namun, semakan Borneonews kepada beberapa orang ADUN Bersatu mendapati mereka tidak menerima sebarang jemputan untuk menghadiri majlis berkenaan.

Persoalan yang timbul adalah adakah Peter sendiri tidak mendapat maklumat yang tepat daripada pihak urusetia, ataupun ada pihak dalaman yang sengaja ingin sabotaj, ataupun mungkin ada pihak dalam Kerajaan Negeri Sabah yang sehingga kini masih tidak senang dengan kewujudan parti Bersatu di Sabah, sungguhpun parti tersebut adalah parti pimpinan Perdana Menteri, Tun Dr. Mahathir Mohamad sendiri.

Ini adalah kerana bukan sahaja Sambutan Hari Kebangsaan tersebut, namun sebahagian besar majlis rasmi Kerajaan Negeri masih tidak menjemput para pemimpin Bersatu Sabah dengan kaedah yang teratur.

Menurut sumber Bersatu Sabah, dalam satu majlis berbuka puasa anjuran Kerajaan Negeri yang melibatkan kehadiran Dr. Mahathir sendiri, penganjur tidak menjemput para pemimpin Bersatu secara rasmi sehinggalah saat akhir jemputan dibuat hanya melalui aplikasi whatsapp melalui pihak ketiga, hanya setelah wakil Bersatu membuat semakan sama ada para pemimpin Bersatu dijemput dalam majlis tersebut.

Sumber Bersatu juga menyatakan, bukan sekadar Sambutan Hari Kebangsaan tersebut, malah majlis rasmi pada malam hari yang sama, yang juga melibatkan kehadirian Tuan Yang Terutama (TYT) iaitu Sambutan Maal Hijrah 1441H, para ADUN, Ahli Parlimen dan Ahli Dewan Negara daripada Bersatu tidak mendapat sebarang jemputan.

Sumber tersebut juga menyatakan kekesalan pihak Bersatu Sabah terhadap pihak yang cuba menimbulkan isu berhubung ketiadaan para ADUN mereka dalam sambutan tersebut, sedangkan hakikat sebenarnya mereka tidak menerima jemputan atau memang tidak dijemput.-pr/BNN65

I REFER to recent reports on the involvement of National Registration Department (NRD) personnel in the alleged issuance of documents to illegal immigrants all over Sabah.

Your report about a NRD staff being arrested in Semporna where several of the State Government’s leaders, including the Chief Minister, Deputy Home Minister under whom the NRD is answerable to and Tourism Minister, not to mention key Sabah police personnel come from, is shocking.

Surely these leaders would wish for these goings-on to be exposed. But what was strange was that the public would not have known what was going on if not for a concerned member who complained about being asked to pay RM3,500 for a birth certificate and RM6,000 for a Mykad, according to Sabah Deputy Police Commissioner Datuk Zaini Jass.

Then we had a woman NRD Assistant Registrar being charged with making a fake identification card. Although she was charged with making a single document, only God knows how many may have obtained theirs through her treasonous action, if she is truly guilty and has claimed trial.

Recently, we had another woman dropping the name of the Semporna-hailed Deputy Home Minister in her scheme to allegedly defraud foreigners hoping to obtain identification documents through fraud.

That case was mysteriously struck off the Central Monitoring System of the courts until members of the public complained to your paper as to why nothing was heard about the case when it was supposed to have been brought up for mention.

Despite the Royal Commission of Inquiry on Illegal Immigrants (RCI), it is sad that Sabah – and only Sabah – seems to be the State with the worst record of foreigners becoming Malaysians through fraud. 

This does not add confidence in Sabahans that the Federal Government is doing its best since the same horrors keep happening even though we threw out the hated Umno-cum-Barisan Nasional at the urging of Tun Dr Mahathir when he was in the opposition. 

Why is he not seen to be doing anything to save Sabah that was already damaged by the Project IC which even the RCI acknowledged for all intents and purposes existed after the PBS pullout from the BN he led then in 1990. There were also complaints that the State was ignored on the appointment of the new UMS Vice Chancellor, the exit tax and introduction of Jawi writing in school.

We cannot entirely blame Dr Mahathir as being 94 and doing his best day and night to put things right. But the enforcement agencies, notably the NRD, is a shame. They seem to have done nothing to repair the damage caused by their staff in the past, many of who have even been arrested under the ISA for it.

When the Home Ministry recently announced a voluntary repatriation programme only peninsula was mentioned Sabah leaders had to beg to be included. Why when Sabah has the most illegals who can make the Sabah claim come true in the future if allowed to stay on. It is a good thing we Sabahans can still rely on the police to do a good job and probably they were motivated by a new role model IGP who has been bold and a new-look MACC who recently spoke of arrests in Sabah and Sarawak being imminent. We salute these good people in uniform, but not the NRD.

Your paper reported sometime back about scores of immigrants flocking to a private clinic in Telipok where a doctor who was also a Commissioner of Oaths was not dispensing medicine but actually attesting the Statutory Declarations of foreigners to submit to the NRD.

The management of the clinic concerned later disassociated with what he was doing and said that it sacked the doctor after investigating the matter and found it to be true. It is widely reported, thanks to social media, that PTIs (illegals) are flocking in droves to some places around the state capital to obtain a certain form and for attestation of the same.

It is believed that the said form was produced by these Commissoners of Oath to accordingly provide personal particulars of the person in question to ease inquiries from relevant parties such as when seeking medical care, etc. The irony is how an undocumented person or PTI be allowed to make a Statutory Declaration for lack of identification papers? Alternatively, it doesn’t make much sense for someone with proper identification papers e.g. with IC or Passport to need such a Statutory Declaration?

Even though this doctor was sacked, it is not the end of the matter. The body overseeing Commissioners of Oath in Sabah should revoke his status and of others who abuse the SD powers given to them. 

But sadly this body is keeping quiet about the whole thing even though some Sabah Law Society exco members are also holding positions in this NGO. Your paper should ask what are they doing about crooked Commissioners of Oath in their midst.

I am also wondering as to what happened to the many Statutory Declarations using that certain form and attested by the said doctor and other Commissioner of Oaths. And why only in Sabah, the use of SDs have been allowed for late registration of births, etc. I understand even Sarawak does not allow this.

Finally, we hope that this letter will come to the attention of our beloved Prime Minister since the national newspapers hardly carry anything about these serious issues concerning Sabah.

Shafie should be grateful to Tan Sri Bernard Giluk Dompok and not Wilfred Madius Tangau.

According to my sources in UPKO which I believe, it was Bernard Dompok who convinced Tangau to jump ship on that night of May 9th 2018 and join Shafie after realising that PH had the majority to form the Federal Government.

Former Sabah Chief Minister Dompok was the first Malaysian to be made a resident ambassador to the Vatican in 2016 and he wanted to save his job when the PH formed the Federal Government. So, he had convinced Tangau to get UPKO jump ship from BN.

I can now understand why PBS is still bitter about UPKOs betrayal. It is because Dr Maximus Ongkili (PBS), Tangau (UPKO) and Joseph Kurup (PBRS) had signed a pledge a week before the May 9th GE14 elections to discuss together as “MISOMPURU” first, before deciding on the next course of action so as to safeguard KDM interests by acting as a bloc.

There was great hope that the presidential council of Upko, PBS and PBRS would pave the way to unite the three main Kadazandusun Murut (KDM)-majority parties in Sabah. The council was seen as a platform to eventually bring together the politically fractious KDM community.

Maximus Ongkili believed that the council could one day unite the KDM parties under a single symbol. That was before it was betrayed by UPKO, moments after GE14.

For UPKO to dishonour what they signed in public and carried in all the media was the  community’s biggest betrayal.

But it is something that is not a surprise considering that their Payar Juman went down in history as Sabahs first political frog. In 1967, UPKO left the Sabah Alliance after the state elections, then Upko’s assemblyman for Kiulu, Payar Juman, crossed to Usno, enabling Usno to form the government then.

Next was when Huguan Siou Tun Fuad Stephens himself betrayed the KDMs by waiting till GS Sundang was in United Kingdom before calling for an EGM to dissolve UPKO. In the EGM Stephens had asked all the UPKO members to join USNO despite angry demands by members not to do so but he himself leaving them in a lurch. Poor GS Sundang who was deputy president was played out.

So if according to historical fact if the Huguan Siou Stephens can do this to his own people, Dr Max should have known better than to expect there will be no betrayal.

The third betrayal, took place in 1994, when  Bernard Dompok from then opposition PBS joined the BN alliance to form the government. I know this vividly as I was a PBS member and I stood for elections in Penang as a PBS candididate.

So looking back,  I dont blame Madius, I blame Dompok!

I hope Dompok will come forward to answer all these allegations.

This is one subject that could take an encyclopedia to wrap up but lets try and figure it out within the scope of this space.

Malaysian politics is often described as being feisty, vibrant, colourful, controversial, debatable, provocative, all of that and more. It all depends on which side of the spectrum you stand and there is a perspective, always. Ask a million people what is wrong with Malaysian politics and you will get a million perspectives. That, in itself tells a story. People are aware, concerned and involved, good or bad, it shows the vibrancy of politics in Malaysia.

People confuse politics with governance. That’s not true. Politics is the means to effect change. All countries and societies effect change all the time; politics is the means to bring about that change. The kind of politics practiced can vary and remain a subject of debate. However, it is at the core of people’s participation in deciding who governs them and how.

Governance is for administrators and bureaucracy, politics is for people’s representatives. People don’t really indulge in politics, they indulge in making political choices and gather groups that agree with them, to elect the leader of their choice. Politics is what the leaders indulge in before and after being elected.

The art of politics lies in being successful in gathering consensus through discussion, debate and persuasion and then pushing that consensus into legislation that results in action and implementation.

What’s Right With Malaysian Politics?

So when we ask what is wrong with Malaysian politics, you have to first acknowledge what is right about it. After all, after 55 years since formation of Malaysia in 1963, Malaysian politics and democracy is alive and vibrant. It becomes even more relevant when we take into account the sheer geographical size of the country and diversity of its people, culture, religion and lifestyle. To get all of that to come together and give people the freedom to choose their voice, can only evoke admiration. This is perhaps Malaysia’s single biggest achievement, since formation and one, it can be proud of.

Sure, it has its flaws, but then what system doesn’t. It’s all about evolving and bringing about change, for the better, through people consensus. That’s politics and it has worked for Malaysia. So before we pull out the knives on Malaysian politics, bear in mind what we have achieved, thus far. It may not be without flaws but it is still the best option. This is our brand of politics and it has worked, for us.

So What’s Wrong With it?

Plenty. We shout over roof tops that we are a democracy and assume that it is also the best. Well, look again. Is the system truly representative? At the time of voting, people make choices based on their belief and understanding of the leader they choose and that leader, post being elected, represents the people, as their voice. That’s idealistic but is that really true? Does the elected leader really reflect what the people want or is it mostly about what that leader wants, often for his own reasons?

Look at the fact on the ground. Majority of Malaysians still live in rural areas and in poverty and poor living conditions especially Sabah and Sarawak and Kelantan and Terengganu and Kedah and Pahang, and with little education or awareness of matters outside their areas of residence. Yet, 98% of the people who would fall in this category are responsible for choosing a government which will legislate over the future of the country.

Too Many Questions….

It is one man – one vote and that is all that matters. Well is it? Is the vast majority really capable of understanding and judging the leaders they choose? The lack of education and awareness, coupled with poverty, often forces the voters to elect leaders who seem to offer them solutions for a better life but instead end up buying or coercing them to vote. So do they really represent the people?

Isn’t it common to see votes being bought and sold in its crudest form? Don’t we see vote bank politics being practiced in its worst form, or votes being garnered on the basis of race or religion? What about votes garnered through threat? It all happens and is part of Malaysian politics.

So can anyone stand up and claim the virtues of Malaysian democracy as being truly fair and truly representative? Should we really beat our chests with pride while proudly claiming to be a democracy?

Free and Fair…. Really?

The ground reality is that politics played at the grass root level can be nasty, coercive and corrupt. Electing representatives is often based on clan and kinship. And most times, its money that buys a position. After all, at the village level, it’s the Ketua Kampung, JKKK, Kapitan Cina, Temenggong, Pemanca or Penghulu that determines the level of respect and influence that an individual commands. That’s the reality and plays a part in the election process.

So can one really say that Malaysian politics be it Sabah or Sarawak or Malaya, at all levels, is truly free and fair? The voting process may be free and fair, at least in most cases, but the process of politics that goes into the run up to elections, and thereafter, is what is questionable. And that’s what is wrong with Malaysian politics.

Let’s take a look at another example. Sabah has always been in the forefront of entertaining politics. But after elections when the courts have to decide who is the rightful Sabah Chief Minister and not wait for a vote of no confidence in the state assembly, it is time to sit up and question the ‘quality’ of politics that we practice. GE14, Musa Aman was first sworn in as Chief Minister at 11.10pm Thursday (May 10) before the Yang di-Pertua Negeri Tun Juhar Mahiruddin at Istana Negeri. In less than 48 hours, Warisan’s Shafie Apdal was sworn in as Chief Minister at 9.30pm Saturday (May 12) by Juhar at the Istana Negeri also. The general election saw a hung assembly when both Sabah Barisan and the coalition of Warisan-PKR-DAP had won 29 seats each in the 60-seat state assembly. And then Datuk Dr Jeffrey Kitingan’s Sabah Star party, which had two seats, became the “kingmaker”. Sabah Star supported Sabah Barisan to give a simple majority of 31 seats, thus allowing Musa to be sworn in as Chief Minister. But by the next day, six Barisan assemblymen – four from Umno and two from Upko – had declared their support for Warisan and its partners PKR-DAP. With the majority support of 35 (out of 60) assemblymen, this allowed Shafie to be sworn in.This matter is still not settled yet, The Court of Appeal will soon decide who is the rightful chief Minister, till then we have to wait and there is still a cloud of uncertainty, its more than 8 months since GE14.

The list of misuse in politics is endless and the ‘quality’ of politics practiced, questionable. The intelligentsia and civil society is aware of the failings, as you and I are too, but the big question before us is – what are we doing about it?

Intolerance to Dissent is a Big Threat

Question, dissent and debate are an essential part of politics and democracy. The ‘quality’ of democracy and politics is judged by the level of debate and dissent allowed, within the party and outside of it. Malaysia is witnessing increasing levels of intolerance to the above and that is very visible in state and national politics. Older parties like the UMNO and PAS have shown signs of intolerance, as have new age parties like Bersatu, Amanah and Warisan. All parties are guilty of quashing dissent in any form. What is a worrying trend is that several parties are resorting to violent means whenever questioned by the people or members of their own parties. Even the media, which serves as a watchdog for the people, has not been spared.

Another problem with Malaysian politics is increasing rowdyism in parliament and state assemblies. On paper, it’s a forum for free and fair debate but in practice, only those with high decibel shouting and aggressive behaviour get heard. What chance does a Dr Jeffrey Kitingan have against a loud and aggressive politician from another party? Yet, on a daily basis we have incessant shouting that passes off as debate. So is this fair on those who do not possess the requisite shouting ability? Is that supposed to be a pre-qualification? The voice of each representative in Parliament must have equal and fair weight and must be given equal opportunity to express his or her viewpoint. That’s easier said, as in practice, it is almost always to the contrary.

And now for the biggest problem of them all, influence and impact of money on Malaysian politics. Politics has degenerated into a business which has a lot of money, some legal but mostly unaccounted, being plowed into it by vested interests. It’s a global phenomenon but a big problem nevertheless. As long as unaccounted money makes its way into politics, it will never be free or fair. And we, as a nation, have to come together to try and figure out how to address this, if Malaysian democracy has to prosper on the bed of fair politics.

It is time for the people to raise their voice and question their leaders and political parties, and force them to change for the better. For we have one non-negotiable weapon, our vote. Isn’t that what democracy is all about?

The older the ginger, the spicier it gets – goes a very popular Chinese idiom. It means the older a person becomes, the wiser the person gets. When Mahathir Mohamad led the opposition coalition, Pakatan Harapan (Alliance of Hope), to a stunning victory in the May 9th general election, the world was shocked and impressed with the emergence of the world’s oldest prime minister.

This is not the first time the grand old man walks the corridors of power. He had enjoyed and tasted the power before – as prime minister for 22 years from 1981 to 2003. But to return to his old job after retired for 15 years is particularly satisfying for him. From a dictator, Mr. Mahathir suddenly becomes a very popular saviour who successfully defeated the evil and corrupt (former) PM Najib Razak.

Heck, he has become so popular that there were concerns the 93-year-old man would be pressured to continue his premiership for as long as he likes, nullifying the agreement to hand over the most powerful job after 2 years to Anwar Ibrahim, his protégé-turned-nemesis-turned-ally. However, Mahathir has repeatedly said he will honour the agreement signed by Pakatan Harapan partners.

The two year period may sound very short, but when a man like Mahathir is put to work, he can deliver more than what an idiot can do in 20 years. The fact that his party – Parti Pribumi Bersatu Malaysia (PPBM) – commands almost the equal share of ministry portfolios among the 4 partners in the ruling coalition, despite being a minority party, was already impressive.

After the historic May 9th win, Anwar’s party (PKR – People’s Justice Party) possessed the lion’s share of 47 parliamentary seats, while DAP (Democratic Action Party) grabbed 42. Mahathir’s PPBM (Malaysian United Indigenous Party) won only 13 seats and Amanah (National Trust Party) managed 11 seats, giving the Pakatan Harapan coalition the required 113 simple majority.

Sure, Mahathir was sworn in as the country’s 7th Prime Minister of Malaysia primarily because all the component parties had agreed to the arrangement. Another factor was due to the fact that there is no dominant party with super majority seats in the coalition. Still, after Anwar was granted a full pardon by the Agong (King) and released from prison, he can kick Mahathir out of the government.

There were strong rumours that Anwar Ibrahim was plotting to partner with either UMNO Malay nationalist party (which was dethroned for the first time in 61 years) or PAS Islamist party or both so that he can instantly grab power. After all, how hard could it be to replace Mahathir’s 13 seats party? Anwar’s advisers believed Mahathir might play him again like in 1998.

Mahathir easily checkmated Anwar, pampered PKR Deputy President Azmin Ali with a very powerful portfolio – a specially created Minister of Economic Affairs. The divide and conquer tactic has essentially split PKR into half. To ensure DAP and ethnic Chinese loyalty to his premiership, Mahathir rewarded them with 6 ministers, including the powerful Minister of Finance.

After ensuring stability and no rebellion within the Pakatan Harapan ruling coalition, Mahathir proceeded to break up the opposition Barisan Nasional coalition. Out of 79 parliamentary seats initially won by the old regime, UMNO alone had in its possession 54 seats. Like a skillful sushi chef, Mahathir skinned Barisan’s so-called fixed-deposit Sarawak Barisan Nasional.

About a month after its humiliating defeat, the extremely corrupt Barisan was shocked when it lost 19 parliamentary seats in June. All the Sarawak parties – PBB, SUPP, PRS, and PDP – abandoned the coalition. Including UPKO (1), PBS (1) and PBRS (1), the Barisan was reduced from 79 to 57. The once arrogant former Deputy PM Zahid Hamidi was reportedly begged the Sarawak Chief Minister not to quit, but to no avail.

It was not a coincidence that Sarawak former Chief Minister Abdul Taib Mahmud’s party PBB, the biggest in the state with 13 parliamentary seats, launched the rebellion after his meeting with PM Mahathir and Daim Zainuddin. In exchange for not investigating Taib’s decades of corruption and illegal logging, Mahathir single-handedly took away Barisan’s fixed-deposit.

UMNO plunged into disarray almost instantly. Its self-proclaimed 3-million members were running around like a headless chicken. From a mighty coalition of 13 component parties, the Barisan Nasional is now reduced to just 3 parties. With MCA and MIC holding 1 seat each (after MIC’s Cameron Highland was declared null and void), the coalition was reduced to 56 seats.

But the slaughtering has just begun. With UMNO members already disillusioned and demoralised by their clueless president Zahid, Mahathir didn’t have to do any heavy lifting. Like it or not, the old man was a master strategist. Besides to gauge the real support of UMNO and PAS, there appeared to be another reason why the anti-ICERD rally was allowed to proceed.

Zahid Hamidi and PAS President Hadi Awang thought the ICERD was a God-sent opportunity to rally the Malays and Muslims against the Mahathir government. The much hyped demonstration had turned out to be a flop – only managed to attract 55,000 protesters. Both gangster Zahid and extremist Hadi had wanted to test the feasibility of UMNO and PAS joining forces.

But the same racial and religious rally would come back to haunt both Zahid and Hadi, sooner than they had expected. On Dec 12, just four days after the mega rally, a mass exodus from Sabah UMNO has begun with nine of 10 of its assemblymen, five of six MPs and two senators leaving the party. There were dozens of reasons (or rather excuses) given for the mass resignations.

However, according to sources, the main reasons were the fear of UMNO becoming too Islamic-centric and getting closer to PAS. There’s a reason why the PAS Islamist party doesn’t have a presence in Sabah. UMNO in Sabah is different from the Peninsular. Perhaps the stupid Zahid Hamidi hadn’t a clue that Sabah UMNO actually has “non-Muslim” members.

A day after the December 8 rally, which Mr. Zahid proudly declared as a huge success and attended by 500,000 Malay-Muslims, PAS and UMNO told all and sundry that they will set-up a joint committee to discuss and deliberate issues concerning the position of Islam as well as special privileges of the Malay, suggesting a partnership or a coalition or even a merger could be on the horizon.

Mahathir was absolutely naughty to give UMNO enough ropes to hang itself. All UMNO Sabah leaders & elected representatives who were leaving the party have pledged full support to the Pakatan Harapan Government under the leadership of Prime Minister Mahathir Mohamad. UMNO is now left with only one assemblyman and one MP in the state of Sabah.

Thanks to anti-ICERD rally, UMNO’s 54 MPs has been diluted further to 43 after the Sabah fiasco. That’s close to half of the initial 79 MPs lost within 6 months under Zahid leadership. Not bad for a Java-migrant who had dreamt of becoming UMNO president. After the collapse of Sabah UMNO, a second wave of exodus from UMNO is reportedly coming very soon.

At least 32 UMNO MPs have allegedly switched loyalty to Mahathir Mohamad. If that happens, UMNO would be crippled with only 11 MPs left, presumably the most toxic and unacceptable even to the “garbage collector” Mahathir. The PPBM now possesses 16 MPs, up from 13 after three UMNO MPs jumped ship earlier on.

If Mahathir’s PPBM decides to accept all the 32 UMNO frogs, it would be boosted with a whopping 48 MPs, just second to Anwar PKR’s 50 MPs. To be fair to him, the prime minister did not say all of UMNO MPs will definitely be accepted. They must first become independent or Pakatan-friendly. This is important because the frogs can be used to initiate institutional reforms.

Yes, as a 13 MPs small “mosquito party”, as previously mocked and insulted by former Tourism and Culture Minister and UMNO warlord Nazri Aziz, it’s incredible that Mahathir could control the 222-seat government. Even without the 32 UMNO frogs, the 19 (Sarawak) and 5 (Sabah) respective friendly votes means Pakatan has 146 votes, just 2 seats shy of two-thirds majority.

Pro-UMNO cybertroopers, propagandists and bloggers had predicted and hoped that a merger between UMNO and PAS could create a new powerful force. They suggested that what Zahid and Hadi needed to do was to scream, whine and bitch about 3R (religion, racial and royalty) and the Pakatan Harapan government would collapse.

Instead of a merger, clearly Mahathir has a better solution – to slaughter UMNO like a pig and deny PAS the satisfaction of taking a free ride out of UMNO misery. From the leader of a minority party, Mahathir has not only divided UMNO into pieces of junks, but also recycle the garbage to become useful parts, without any promise of keeping the trash.

Jamal Khashoggi’s disappearance has opened a rift between Washington and Saudi Arabia, the chief Arab ally of the Trump administration. And it has badly damaged the reputation of Crown Prince Mohammed bin Salman, the 33-year-old power behind the Saudi throne, who this time may have gone too far for even for his staunchest supporters in the West.

The possibility that the young prince ordered a hit on a dissident poses challenges for President Trump and may turn once warm relationships toxic. It could convince those governments and corporations that had overlooked the prince’s destructive military campaign in Yemen, his kidnapping of the Lebanese prime minister and his waves of arrests that he is a ruthless autocrat who will stop at nothing to get his enemies.

FIFTEEN SAUDIS GO TO ISTANBUL IN TWO BUSINESS JETS, WITH A DOCTOR AND A HACKSAW MAN AMONG OTHERS, AND THEN SAY IT WAS AN ACCIDENT.

But international outrage mounted as Turkish officials leaked lurid details from their own investigation suggesting that he was murdered inside the consulate and dismembered by a team of 15 Saudi agents who flew in specifically to kill him.

The case has battered the international reputation of the kingdom and its 33-year-old crown prince, Mohammed bin Salman, who has sought to sell himself to the world as a young reformer shaking off his country’s conservative past. But suspicions that such a complicated foreign operation could not have been launched without at least his tacit approval have driven away many of his staunchest foreign supporters.

Saudi Arabia said Saturday that Jamal Khashoggi, the dissident Saudi journalist who disappeared more than two weeks ago, died after an argument and fistfight with unidentified men inside the Saudi Consulate in Istanbul.

Eighteen Saudi men have been arrested and are being investigated in the case, Saudi state-run media reported without identifying any of them.

State media also reported that Saud al-Qahtani, a close aide to the crown prince, had been dismissed, along with Maj. Gen. Ahmed al-Assiri, the deputy director of Saudi intelligence, and other high-ranking intelligence officials. They did not say whether the men’s firing had a connection to the Khashoggi case or whether they were being investigated for playing a role in it.

Its been going on for three years now. Saudi Arabia, the richest and most well armed nation in the region, and backed by the USA and Israel, has been raining havoc on Yemen, the poorest and most distressed of middle eastern nations. Yemen is backed by Iran. it is war with no winners but the western arms companies.

In terms of human costs, the Yemen war is a picture of unmitigated loss: millions of Yemenis facing starvation; over 17,000 killed or wounded; an infrastructure in ruins, with hospitals, clinics, schools, factories, homes, and even universities bombed; indiscriminate aerial attacks and artillery shelling of civilians, exposing commanders of warring parties to criminal liability; and Saudi Arabia’s global reputation—despite an army of public relations firms working feverishly on its behalf—in tatters.

However, the Yemen war has been a huge financial boon for American and British defense contractors (and their shareholders). Raytheon, General Dynamics, and BAE Systems are awash in tens of billions of dollars from arms sales to their rich clients, Saudi Arabia and the United Arab Emirates. They astutely spend a fraction of their profits to lobby their own governments to approve these sales, despite the overwhelming evidence of repeated misuse of these weapons in unlawful attacks that should lead to a ban on such activity. Fear of lost arms sales is today America’s pathetic basis for certifying that the Saudi-led coalition is “working to minimize civilian casualties.””
